Terms of participation

General Conditions for the participation in the MotoGP™ eSport Championship 2023

The company DORNA SPORTS, S.L. (DORNA) a company incorporated under the Laws of Spain with its registered office at Madrid - 28002, c/ Príncipe de Vergara, 183, organize a worldwide MotoGP™ eSport Championship in accordance with the following Conditions and the MotoGP™ eSport Championship "How to play" (RULES).

1. Participants

All the participants must be duly registered and shall comply with the following:

  • ·   Must be natural persons.
  • ·   Own or have access to Official MotoGP™23 and/or Official MotoGP™23 videogames.
  • ·   Own a PlayStation™ Network Account and or Xbox Live Gold Account and or Steam Account (PC platform).
  • ·   Have internet connection.

DORNA reserves the right to refuse accepting the application of participant names that are considered by DORNA, at its sole discretion, to be inappropriate or offensive. Unsuitable names will be deleted, and the application will be displayed under a default name chosen by DORNA, previously communicated by DORNA. Please bear this in mind when you choose the name for your registration at esport.motogp.com.

DORNA is not responsible in case of loss (email, password) of the Participants’s account.

2. MotoGP™ eSport Championship

The MotoGP™ eSport Championship is the only and exclusively eSports Championship for the Official MotoGP™ videogame.

3. Phases of the Championship

The 2023 Championship will have two phases: The Pro Draft and the Global Series, which shall proceed as follows:

3.1 PRO DRAFT:

The Pro Draft 2023 will consist of three (3) Online Challenges and one (1) Draft Selection Period.

3.1.1 Online Challenges

All Online Challenges will be disputed in time attack mode on a particular track, with a particular MotoGP™ rider and particular bike without any opponents, with the purpose of setting the fastest single lap time.

For all Online Challenges the track, the rider, the bike, riding options, as well as any other relevant conditions, will be decided by the organizers and cannot be changed. Weather conditions will be pre-set and cannot be changed as well.

The participant will be able to choose exclusively between “manual” or “semi-automatic” transmission mode.

The “bike damages”, “tire consumption”, the “Ideal trajectory line” and the “rewind” feature will be disabled.

The participant will be also able to change the level of Traction Control, Brake System, Anti Wheelie, Suspension, level of fuel ECU, Gear Ratio, tires and different steering adjustments.

The Participant may attempt each of the Online Challenges as many times as each Participant decides.

These Online Challenges will be available in the game Official MotoGP™23 videogame, on the following platforms, which are indistinctly considered for classification purposes: PlayStation 4, PlayStation 5, Xbox One, Xbox Series X & S and Pc via Steam gaming platform, each Online Challenge is open for participation for a limited period of time, as chosen by DORNA and it is only accessible for a limited period of time, such period will be updated and duly published and communicated to all participants from time to time.

Time penalties does not apply on Online Challenges. In case of any irregularities, such as exceeding the track limits, falling at any point, and collisions with walls or other elements, the current lap time will be considered invalid.

Best laps of each Online Challenge will be available through MotoGP™23 as impersonal ghosts. All ghosts can be downloaded by all competitors and loaded for the participant attempt to enable a visual reference of the current best on-track performance.

The organization is entitled to check all ghosts, in order to verify that a lap time has been achieved without cheating. For the purpose of considering a valid qualifying time, uploading the ghost is mandatory when the lap time is ranked in the Top 30 lap times within the Championship standings.

DORNA may modify or cancel any of the challenges. If a challenge is canceled or modified for whatever reason no claims can be made against DORNA.

Each Online Challenge will have its own leaderboard which will be available to all participants during and after each Online Challenge period.

After each Online Challenge, top fifteen (15) participants per platform and region (EU-Rest of the World) who achieve the fastest single lap time will be awarded with the following points depending on their final position according to the official MotoGP™ scoring system:

1ST: 25 points

2ND: 20 points

3RD: 16 points

4TH: 13 points

5TH: 11 points

6TH: 10 points

7TH: 9 points

8TH: 8 points

9TH: 7 points

10TH: 6 points

11TH: 5 points

12TH: 4 points

13TH: 3 points

14TH: 2 points

15TH: 1 points

All participants will be able to participate across multiple platforms, and each Participant is entitled to freely choose in which platform will participate in the Online Challenge. Such timely election will be made on the Online Challenge 1 (or the first online challenge in which the participant first enters). Participants hereinafter shall participate with the platform whereby the participant has achieved the best qualification position.

If a participant reaches the same standing position in different platforms, the participant shall continue participating in the foregoing Challenges with the platform in which the participant has completed and uploaded the last best qualification.

In case of identical lap times across multiple participant and platforms, the first participant to complete and upload the Online Challenge will qualify first.

For avoidance of doubt, if a participant has achieved his best position through PlayStation platform, such participant shall join in Online Challenge 2 and Online Challenge 3 only on PlayStation platform. If a participant has achieved his best position through Xbox platform, then the participant shall join in Online Challenge 2 and Online Challenge 3 only on Xbox platform. If a participant has achieved his best position through PC, such participant shall join in Online Challenge 2 and Online Challenge 3 only on PC.

Following the conclusion of each Online Challenge the participants who achieve the fastest lap times will be organized in 2 different rankings, European Ranking and Rest of the World Ranking.

The European Ranking includes the following countries: Albania, Andorra, Armenia, Austria, Azerbaijan, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Republic of Belarus, Republic of Kosovo, Republic of Moldova, Monaco, Montenegro, Netherlands, North Macedonia, Norway, Poland, Portugal, Romania, Russian Federation, San Marino, Serbia, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Ukraine and United Kingdom and Vatican City.

The Rest of the World Ranking includes all the countries that are not included in the list above will be considered as a Rest of the World.

Top participants with the highest points at the end of Online Challenge 3 shall qualify for the Draft Selection. In total, 22 participants shall qualify (15 from European Ranking and 7 from the Rest of the World Ranking).

In the event that a participant equals on points with another participant following the Final Standings (after the third online challenge), the participant whose aggregate number of Challenges wins is higher will be ranked higher. If such aggregate number of Challenges wins is the same, then the Rider whose aggregate number of 2nd place finishes is higher will be ranked higher. If such aggregate number of 2nd place finishes is the same then the aggregate number of 3rd place finishes will be considered, and so on.

In case that 2 participant equals on points and also on aggregate number of final position, the final ranking will be decided by the time that the best lap of Challenge 3 was completed and uploaded, the participant who sets the best lap time first will be ranked at the higher on the leaderboard.

All the participants classified for the Draft Selection will be notified at the e-mail address provided at the time of registration, by no later than five working (5) days after the closing date of the challenge in question. DORNA shall not be responsible for incomplete or invalid e-mail addresses provided by the participants neither for other circumstances by which the participant does not read such notification.

The non-response of any participant, to the communications from DORNA within three (3) working days, may be considered as a waiver of the participant who has committed such omission. DORNA upon its own discretion may contact again the participant or permanently disqualify the participant from the current yearly championship. In this case, the disqualified participant will be subdued by the participant having the best following standing position on the same ranking.

3.1.2 Draft Selection

MotoGP™ Teams may select their participant from the Draft Pool. The Draft Pool consists of the selection of participants that have qualified in the top 22 standing position of the Pro Draft 2023 plus the winner of the Rising Stars Series 2022. In the Draft Pool there will be 23 eligible participants for MotoGP™ Teams’ selection. This selection will consist in eleven (11) Official MotoGP™ eSport Riders and twelve (12) Reserve MotoGP™ eSport Riders.

Each MotoGP™ Team may select 1 Official MotoGP™ eSport Rider from the Draft Pool during Draft Pick, the Draft Pick period will take place at specific time decided by DORNA.

The twenty-two (22) participants who have qualified on the Online Challenges of the Pro Draft 2023 and the winner of the Rising Stars Series 2022 will be eligible on equal terms.

Once a MotoGP™ Team has selected the Official MotoGP™ eSport Rider, such MotoGP™ eSport Rider will represent their team in the MotoGP™ eSport Championship 2023.

When a MotoGP™ Team has selected the Official MotoGP™ eSport Rider from the Draft Pool, each Team shall notify DORNA the Draft Pick, and after having received all Team’s Draft Pick, DORNA shall announce the final start list of riders. A Draft Pick will not be officially recognized until it has been formally announced by DORNA at the final start list.

In case that a Participant is not selected, at the end of the Draft period, DORNA will assign such Participant to a Team. The assignation of the remaining Participants, will be according to the final standing position of the participants.

In case of withdrawal or exclusion of an Official MotoGP™ eSport Rider in the MotoGP™ eSport Championship (such as, but not limited to, withdrawal, disqualification or ineligibility because of medical issues), the relevant Team having a rider position available, will be entitled to replace the position with a Reserve Rider. In this case, DORNA and/or the Teams will book and bear the cost of travel and accommodation for the attendance of the Participants to the Global Series events.

All the official MotoGP™ eSport Riders shall select a different bib number for the Global Series 2023. Numbers 58, 69 and 74 are not available for selection under no circumstances.

3.2 GLOBAL SERIES.

The Global Series comprises four (4) Rounds of competition, in which the participants contend in a 12-Race league-format Championship (4 eSport Sprint and 8 eSport Races). All races will be disputed on PC and every Rider will be able to choose his own controller (Xbox, PlayStation controller or PC keyboard).

The Global Series 2023 will consist of Virtual Rounds and On Site Rounds.

The Global Series determines the final standings of the MotoGP™ eSport Championship according to the following Rider’s Championship Points awards:

Following the conclusion of the Virtual Rounds of the Global Series, the participants will be awarded with the following points upon their finishing positions in each of the respective Races as follows

eSport Sprint

1ST: 12 points

2ND: 9 points

3RD: 7 points

4TH: 6 points

eSport Races

Following the conclusion of the On Site Rounds of the Global Series, the participants will be awarded with the following points upon their finishing positions in each of the respective Races as follows:

The MotoGP™ eSport Champion of the season 2023 will be the participant scoring the higher number of points after the last race of the Global Series.

In the event that two (2) participants equals on points after the last race of the Global Series, the number of single race wins will break the tie (only Global Series races are considered), then the participant with more wins will be ranked preferentially. In the event that the participants equals on single race wins, the number of single race second positions will be considered, and in case of second position draw, the number of single race third position will be considered and so on.

In the event that two participants equals on points and on the aggregate number of Race positions, then the participant with more eSport Sprint wins will be ranked preferentially. In the event that the participants equals also on eSport Sprint wins, the number of single eSport Sprint second positions will be considered, and in case of second position draw, the number of single eSport Sprint third position will be considered and so on.

In the event that two participants equals on points and on the aggregate number of Race and eSport Sprint positions then the participant who achieve the best Race position at the last Race of the Global Series will be higher ranked.

In the event of a participant has some technical problem during the Online Races, the Race Director at its sole discretion will decide if the race has to be canceled and restarted from the beginning. If the Race has to be restarted, the Race Director will show a Red Flag.

As a result of the Red Flag every participant will see on their screen an indication of the Red Flag. It’s important to note that the session will not restart automatically. The Race Director will restart the session. As a result of this action the race will restart from the formation lap.

If an eSport Rider has technical problems and is not able to connect to the Online Race server, due to his/her own technical devices, the Race Director is entitled to delay up to 15 minutes from the time initially established for the Race start. In case that the participant continues having technical problems and he/she is still unable to access to the server, the Race Director will take the decision of starting the race excluding such participant, or to extend the waiting period. The Race Director decision are discretional and will be taken at all times in the interest of the championship.

In order to present a complaint incident report, participants shall send to DORNA the videos of the incidents. DORNA will analyze such incidents and will take a decision. The Race Director will always have the final call on the decision.

After the Online Race there will be a 24h claims period counted from the relevant race, after this period, claims will not be accepted.

4. Rising Stars Series

The Rising Stars Series 2023 will consist in three (3) Online Challenges and one (1) Online Final Race.

4.1 ONLINE CHALLENGES.

For clarification, Rising Stars ONLINE CHALLENGES are different from Pro Draft Online Challenges.

The participants classified for the Global Series 2023 will not be able to participate in the Rising Stars Series 2023.

For each Online Challenges the track, the rider, the bike, riding options, as well as any other relevant conditions, will be decided by the organization and cannot be changed. Weather conditions will be pre-set and cannot be changed as well.

The EU countries are: Albania, Andorra, Armenia, Austria, Azerbaijan, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Republic of Belarus, Republic of Kosovo, Republic of Moldova, Monaco, Montenegro, Netherlands, North Macedonia, Norway, Poland, Portugal, Romania, Russian Federation, San Marino, Serbia, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Ukraine and United Kingdom and Vatican City.

The African countries are: Algeria, Angola, Benin, Botswana, Burkina Faso, Burundi, Cameroon, Cape Verde, Central African Republic, Chad, Comoros, Congo-Brazzaville, Congo-Kinshasa, Côte d'Ivoire, Djibouti, Egypt, Equatorial Guinea, Eritrea, Ethiopia, Eswatini, Gabon, Gambia, Ghana, Guinea, Guinea-Bissau, Kenya, Lesotho, Liberia, Libya, Madagascar, Malawi, Mali, Mauritania, Mauritius, Mayotte, Morocco, Mozambique, Namibia, Niger, Nigeria, Reunion, Rwanda, Saint Helena, Sao Tome and Principe, Senegal, Seychelles, Sierra Leone, Somalia, South Africa, South Sudan, Sudan, Swaziland, Tanzania, Togo, Tunisia, Uganda, West Sahara, Zambia and Zimbabwe.

The Asian countries are: Afghanistan, Armenia, Azerbaijan, Bahrain, Bangladesh, Bhutan, British Indian Ocean Territory, Brunei, Cambodia, Republic of China, Christmas Island, Cocos (Keeling) Islands, Hong Kong, India, Indonesia, Iran, Iraq, Israel, Japan, Jordan, Kazakhstan, North Korea, South Korea, Kuwait, Kyrgyzstan, Laos, Lebanon, Macau, Malaysia, Maldives, Mongolia, Burma, Nepal, Oman, Pakistan, Palestine, Philippines, Qatar, Saudi Arabia, Singapore, Sri Lanka, Syria, Taiwan, Tajikistan, Thailand, East Timor, Turkey, Turkmenistan, United Arab Emirates, Uzbekistan, Vietnam and Yemen.

he Oceanian countries are: American Samoa, Australia, Christmas Island, Cook Islands, Fiji, French Polynesia, Guam, Kiribati, Marshall Islands, Micronesia, Nauru, New Caledonia, New Zealand, Norfolk Island, Northern Mariana Islands, Palau, Papua New Guinea, Pitcairn Islands, Samoa, Solomon Islands, Tokelau, Tonga, Tuvalu, Vanuatu, Wallis and Futuna.

The American countries are: Anguilla, Antigua and Barbuda, Argentina, Aruba, Bahamas, Barbados, Belize, Bermuda, Bolivia , Brazil, British Virgin Islands, Canada, Cayman Islands, Chile, Colombia, Costa Rica, Cuba, Dominica, Dominican Republic, Ecuador, El Salvador, Falkland Islands , French Guiana, Greenland, Grenada, Guadeloupe, Guatemala, Guyana, Haiti, Honduras, Jamaica, Martinique, Mexico, Montserrat, Navassa Island , Netherlands Antilles, Nicaragua, Panama, Paraguay, Peru, Puerto Rico, Saint Kitts and Nevis, Saint Lucia, Saint-Pierre and Miquelon, Saint Vincent and the Grenadines, Suriname, Trinidad and Tobago, Turks and Caicos Islands, United States, United States Virgin Islands, Uruguay and Venezuela.

The participants who have accumulated the highest number of points after Challenge 3 will be classified for the Online Regional Final. In total 9 participants will be classified for the Online Regional Finals (3 participants from Europe & Africa, 3 from the Americas and 3 participants form Asia & Oceania).

All the participants qualified for the Online Regional Finals will be notified by e-mail by no later than five working (5) days after the end of the relevant challenge.

The non-response of any participant, to the communications from DORNA within three (3) working days, may be considered as a waiver of the participant who has committed such omission. DORNA upon its own discretion may contact again the participant or permanently disqualify the participant from the current yearly championship In this case, the disqualified participant will be subdued by the participant having the best following standing position on the same ranking.

4.2 ONLINE REGIONAL FINALS.

The Online Regional Final will consist in one (1) Online Race.

The Online Race shall be disputed only through PC platform and the Race will be available only at specific scheduled time as decided by DORNA.

Participants will be able to choose the bike they will ride during the Online Race depending on their finishing standing positions as follows: the participant with the higher number of points has first pick, the second participant with most points has second pick, and so on until all participants have chosen a different motorbike.

The Online Race will consist in one Qualifying Session and one Race. Both steps will be held in one single event.

The Qualifying sessions will have a duration of 15 minutes.

The participants starting position on the race shall be decided on the Qualifying Session. The participant will be classified according to the results of the Qualifying Session.

The Race will be held according to the options specified below:

Tire consumption: ON

Collisions: ON

Fuel consumption: ON

Damages: OFF

The winner of the Online Final Race will qualify for the Pro Draft 2024.

5. General Rules

By participating in the MotoGP eSport Championship, each and all participants agree that he or she shall attend and fully participate in all media, marketing, promotional and related activities in connection with the MotoGP™ eSport Championship to the extent required by DORNA.

The use of drugs or alcohol may be considered a disruptive behavior. Participants believed to be under the influence of drugs at any given time during an event of the MotoGP™ eSport Global Series will be removed from the event and disqualified from taking part in any MotoGP™ eSport Championship. For this purpose, "any given time during the event" covers 24 hours prior to the Global Series, to 24 hours after the conclusion of such event. No MotoGP eSport Riders should be under the influence of alcohol or drugs during an event. The excessive drinking of alcohol and taking of any illegal or performance enhancing drugs is strictly forbidden at any time during an event of the MotoGP™ eSport Championship.

Betting or gambling activities may be considered as well disruptive behavior. Participants believed to be betting or gambling or cooperating or in partnership with third persons performing such activities will be removed from the event and disqualified from taking part in any MotoGP™ eSport Championship. The performance and/or benefit from betting or gambling activities is not allowed Participants or related person may not benefit directly or indirectly from any spot-fixing, betting or gambling in connection with the MotoGP™ eSport Championship or any event related to the MotoGP™ eSport Championship.

All Participants agree to conduct themselves in a manner that reflects positively on the MotoGP™ eSport Championship in all respects.

Filming and sharing videos/pictures is not permitted inside the circuit, paddock or eSport area. Filming in these locations is considered inherently disruptive of the function of the MotoGP™ eSport Championship.

All Participants’ pods/technical equipment will be the same in all material respects in order to guarantee fair competition between them. Hardware or equipment allocation shall be determined by DORNA and such decision shall be final and mandatory for all Participants. Participants will not be permitted to alter the set-up of the pods.

The Participants agrees he/she shall wear the uniform provided by DORNA or by a MotoGP Team.

All the uniforms shall include the official MotoGP eSport logotype, DORNA will provide the MotoGP Teams with the official MotoGP eSport logotype.

DORNA has a right to take decisions to guarantee the fair play and to ensure the spirit of the MotoGP™ eSport Championship is upheld. MotoGP eSport Rider agree to be bound by DORNA’s final decisions of and anyone acting on DORNA’s behalf.

No forms of cheating, gameplay, gamesmanship or gaining an unfair advantage in any way will be tolerated. DORNA may apply any technical measures to detect unfair competition behaviors. The participants who may be found cheating or involved in facilitating cheating activities will be removed from the event and disqualified from taking part in any MotoGP™ eSport Championship. In the specific case that two participants have achieved top ranking positions in any of the events and it is noticed that technical data matches (such as platform, user account or other matching data), DORNA may check the laps, times and any other relevant data in order to check the fair development and competition.

Any offensive, disrespectful or unsportsmanlike behavior (including but not limited to insults and physical violence and including any behavior which in DORNA’s opinion may bring it, any of its affiliates, the MotoGP™ eSport Championship or the MotoGP™ in general into disrepute) connected to MotoGP™ eSport Championship will be punished and may lead to disqualification.

DORNA has a right to decide decisions in accordance with these General Rules, outside these General Rules, or even against these General Rules in special cases to guarantee fair play and to ensure the spirit of the MotoGP™ eSport Championship is upheld. Participants agree to be bound by DORNA’s final decisions of and anyone acting on DORNA’s behalf. The breach of any of the rules included in this terms of participation may include the irrevocable and immediate disqualification of a Participant.

All decisions regarding the interpretation of the rules, eligibility, scheduling and staging of the MotoGP™ eSport Championship, and penalties for misconduct, lie solely with DORNA, whose decisions are final. DORNA’s decisions cannot be appealed and shall not give rise to any claim for monetary damages or any other legal or equitable remedy.

6. Track Behavior & Penalties

Penalties will be given to MotoGP eSport Rider infringing or breaking etiquette code..

The Race Director will have the final decision on the time penalty given to the offending Participant.

Any Participant deemed by Race Control showing or performing rough or unsportsmanlike driving may be penalized. The Race Control shall determine the relevant penalty at any time. If a Participant is declared responsible, by the Race Control, to cause a collision that affected any other Participant (removing from the track other participants or causing falls and accidents intentionally, will be considered as rough or unsportsmanlike driving), the causing Participant may be penalized.

Each Participant is responsible of performing a fair and responsible competition and driving. In the event that a participant overtakes a third participant, the participant that is being overtaken must as well perform fair and responsible driving, avoiding blocking and other unfair maneuvers.

Participants who cause falls and/or accidents which could be avoided performing a responsible and fair driving will be analyzed and are subject to be penalized.

If a Participant leaves the track but this is due to his/her own mistake and no advantage is earned, a warning may be applied.

The Red Flag is used to communicate that the session is cancelled and the race will restart from the beginning.

As a result of the Red Flag every participant will see on their screen an indication of the Red Flag. It’s important to note that the session will not restart automatically. It is the Race Director who will restart the session.

As a result of this action the race will restart from the formation lap.

All the participants should be informed before the start of the Global Series that unfair behaviors will be punished with Warnings. These behaviors should include:

  • ·   Corner cutting;
  • ·   voluntary maneuvers that cause other participants to fall or crash;
  • ·   repeated changes of riding trajectories;
  • ·   moving around the track very slowly being an obstacle for faster riders (during qualifications);
  • ·   racing outside the track even if not cutting corners;
  • ·   screaming or interfering with other participants outside of the game.

Warnings may also be applied if a Participant is deemed to be in breach of any of these rules, even if the breach was not intentional and no advantage was earned as well as no prejudice is caused to other Participants.

Warnings include all kind of penalty such as time penalty and verbal warning, excluding flags described above. There is not a Warnings limit that a participant can be assigned before taking the Black Flag: it is up to the Race Director to decide when to disqualify one of the participants.

The Race Director will always have the final call on the decision and it’s the exclusive organism entitle to make warnings, activate flags or give any other penalty that may proceed.

The Race Director decision are discretional and will be taken at all times in the interest of the championship.

7. PARTICIPANT for the purposes of this Terms & Conditions shall mean MotoGP™ eSport rider 2023. PARTICIPANT acknowledges and accepts the following:

The PARTICIPANT SHALL BE AT LEAST 16 YEARS OLD, when notified by e-mail, the PARTICIPANT shall provide copy of their valid passport as well as a sworn statement that he/she is of legal age in his/her national country and has not been deprived of any right to participate in the MotoGP™ eSport Championship and/or in the Rising Stars Series.

When the PARTICIPANT is under age, he/she must send DORNA, when notified by DORNA, the UNDERAGED LIABILITY WAIVER provided by DORNA, duly signed by his/her Parents or Legal Guardian and must be accompanied by one of his/her parents or Legal Guardian at all the Events that the PARTICIPANT may attend.

DORNA will book and bear the cost of Parents or Legal Guardians (one Parent or Legal Guardian per under age) travel and accommodation for their attendance to the Global Series events.

The PARTICIPANTS that may enter in any event that requires traveling to other countries, are responsible for securing their own visas or official ID allowing them to enter in the country where the event takes place, as well as fulfilling any other requirement (such as safety and health requirements imposed by public authorities or governments from time to time) and any other document needed to travel in order to attend the Global Series events in the relevant country. If a PARTICIPANTS is unable to secure a visa for any reason, they will be disqualified from the Global Series events. The PARTICIPANTS shall provide to DORNA all the relevant documents mentioned upon DORNA´s request.

The PARTICIPANT acknowledges and agrees that by participating in the Global Series, he/she grants in exclusivity to DORNA their image rights arising out of their participation in the Global Series events (in perpetuity and worldwide) by signing the corresponding document that will be signed by the PARTICIPANT, before their participation in the Global Series.

The PARTICIPANT is liable to support DORNA's and the MotoGP™ eSport Championship's and the MotoGP™ eSport Championship's image and reputation, avoiding any activity or public information which could damage or negatively affect it as well as doing or permitting any act which might adversely affect any of MotoGP™ or MotoGP™ eSport Championship\’s commercial rights or the value of its commercial rights. Therefore its breach entitles DORNA to disqualify automatically the PARTICIPANT.

The PARTICIPANT acknowledges and agrees he/she is in good health and he/she is unaware of any physical condition that would at all: affect his/her ability to participate in the Global Series; or would otherwise contribute to increase the risk inherent in the activities included in or associated with the Global Series.

Dress Code: PARTICIPANT must wear attire appropriate to the circumstances and location at which the Global Series is taking place. The PARTICIPANT shall not wear, carry or bear any items of a religious or political nature, or those at DORNA’s criteria reflects not desirable or inappropriate opinions. DORNA reserves the right to require the PARTICIPANT to wear a uniform (as provided by DORNA or provided by a MotoGP™ Team).

The personal or individual sponsorship is not permitted during the MotoGP™ eSport Championship events, inside the circuit, paddock or eSport area unless previous written approval from DORNA.

Drugs and Alcohol: Use of alcohol or drugs is prohibited on the premises of, or during the attendance of, the Global Series events. The PARTICIPANTS must not be under the influence of drugs or alcohol while participating, as mentioned above.

Smoking is prohibited except in designated areas.

In the event that a PARTICIPANT already qualified, is not able to attend or has been disqualified for the corresponding phase, the following best-qualified PARTICIPANT shall substitute the first one.

DORNA has drafted and established Health, Safety and Organization Protocols. Said Health, Safety and Organization Protocols are applicable, and any and all participants attending to the venues or onsite events, shall be bound by it and undertakes to comply with it. Said protocols are mandatory to any person accessing in the venues at any event. Said protocols (as amended by DORNA from time to time and as provided by DORNA to the participants well in advance before the relevant Events) shall integrate and supplement the present Terms & Conditions and the Participants shall be bound to comply with it. Fulfilling DORNA’s protocols and safety measures, and any instructions is mandatory. Not fulfilling DORNA’s instructions in such regard shall be considered as a breach of the T&C and DORNA shall be entitled to immediately cancel or exclude an infringing participant.

For clarification, the infringement of any of the above requirements, and any other mentioned in the present Terms & Conditions by any PARTICIPANT entitles DORNA to sanction or disqualify or event to expel from the venues the relevant rider. DORNA shall decide at its own discretion the measures or actions from time to time according to the infringement.

8. Championship Administrator: DORNA is the sole operator of the MotoGP™ eSport Championship and can be contacted through esport.motogp.com.

9. Agreement to the RULES and the decisions made by the Championship Administrator.

By participating in the MotoGP™ eSport Championship, the Participants agree to comply and follow the RULES published in esport.motogp.com as well as the decisions made by the Championship Administrator, whose decisions are final and binding.

Every Participant acknowledges and accepts the right of the Championship Administrator, to modify the RULES in the spirit of creating a fair competition at any given time and without prior notice. The application of THE RULES is at the sole discretion of the Championship Administrator. Every Participant is asked to maintain an adequate level of respect and friendliness with the other participants and the Championship Administrator.

Participants must abide to the instructions made by the Championship Administrator at all times. All participants must follow the Championship Administrator´s directions.

Unsportsmanlike and disrespectful behavior towards the Championship Administrator and the other participants will not be tolerated. Incidents will be acknowledged at the sole discretion of the Championship Administrator and the Championship Administrator reserves the right to disqualify or exclude any Participant from the competition at any level, any time, and for any reason.

10. Prizes:

The prizes shall be provided and delivered directly to the winners by third parties. DORNA shall not be responsible for the provision and delivery of the prizes.

Prizes pictured in the MotoGP™ eSport Championship materials (including esport.motogp.com.) are for illustration purposes only. Actual prizes may vary from the pictured prize.

Prizes referred to on the esport.motogp.com will only be attributed, complying with all applicable laws, to Participants with legal residence/domicile in any given territory where the prize can be legally delivered. Tax regulation of the prizes will be according to the applicable law.

In the event a minor child/underage wins a prize; the prize shall be accepted by his/her parent or Legal guardian.

11. Personal Data:

The PARTICIPANT is informed that his/her personal data will be processed by DORNA SPORTS, S.L., as Data Controller, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) for managing his/her participation in the MotoGP eSport Championship as well as other purposes mentioned herein arising from the contractual relationship generated between the parties through MotoGP eSport Championship participation.

The registration of the PARTICIPANT and participation in MotoGP eSport Championship implies the treatment by DORNA of the personal data provided to process the registration and also implies the treatment of the personal data derived from his participation in the MotoGP eSport Championship and events linked to the same, for its technical administration, and the correct management of the services available and/or requested by the PARTICIPANT, as well as, where appropriate, its invoicing and the prevention of fraud in its acquisition.

For these purposes, DORNA will process the personal data requested in the corresponding registration form provided for this purpose and the data derived from the PARTICIPANT's experience in the competition. In general, the type of data processed will be as follows:

  • ·   Identification and contact data: name, surname, login name, ID number and/or passport, email, telephone number, city, country.
  • ·   Personal characteristics data: age, nationality, gender.
  • ·   Data relating to the competition experience such as results, ranking, interactions, settings, and points scored.
  • ·   Image and voice (photography, video capture).

The processing of data relating to the health of the PARTICIPANT may be required in the event that it is necessary for the application of the Health, Safety and Organisational Protocols implemented within the framework of the MotoGP eSport Championship for its correct development.

The PARTICIPANT'S participation in the MotoGP eSport Championship requires the provision and processing by DORNA of third-party data, exclusively for the purpose of complementing the lack of capacity of the PARTICIPANT when he/she is not of legal age, which consist of Father/mother/legal representative of the PARTICIPANT identification and contact details: Name, surname, ID and/or passport number, signature, telephone number and e-mail address.

The lawfulness of the processing is the performance of the contractual relationship established through the acceptance of the General Conditions for the participation in the MotoGP™ eSport Championship, in accordance with Article 6.1(b) GDPR.

Likewise, the personal data of the PARTICIPANT and/or parent or legal representative, if applicable, will be processed when necessary to comply with legal obligations required of DORNA, based on article 6.1.e) RGPD related to the applicable legislation in civil, administrative, criminal or any other applicable matters.

For the purpose of keeping your personal data updated, Participant shall inform DORNA of any change that may occur with respect to the User’s personal data.

DORNA reserves the right to carry out the corresponding controls to verify the authenticity of the personal data provided, as a means of avoiding fraudulent use of the services offered.

The PARTICIPANT'S personal data will be processed for as long as it is necessary for the management of the participation in the MotoGP™ eSport Championship. Once the event has ended, the data will be kept duly blocked for the period corresponding to the statute of limitations for any legal actions that may arise from participation in the competition. They may also be kept indefinitely: (i) the data necessary for the certification of attendance or participation in the competition; (ii) data included in audiovisual records; (iii) data that must be kept in accordance with legislation on historical or documentary heritage and/or archiving.

DORNA has adopted technical and organizational measures to guarantee the confidentiality, integrity, availability and permanent resilience of every systems and processing services, as well as avoiding alteration, loss, treatment or unauthorized access to such personal data.

Participant personal data may be communicated to DORNA’s necessary service providers, and even could be the object of an international data transfer to countries located outside the European Economic Area, including countries that do not provide an adequate data protection level, equivalent to European Regulation. In such cases, any legal steps shall be taken in order to guarantee an adequate data protection level. In particular, Participant’s data may be transferred to E.E.U.U. by the Salesforce provider, which transfer has been authorized by the Spanish Data Protection Agency.

The PARTICIPANT may exercise his/her rights of access, rectification, erasure, restriction, objection, and portability by contacting DORNA at the following address: c/ Príncipe de Vergara, 183, 28002 Madrid, Spain, or by sending an e-mail to the address of the Data Protection Officer appointed by the Data Controller: dpo@dorna.com. Likewise, as a registered user, you may exercise your rights and manage your preferences through the "My profile" section, as informed in the general Privacy Policy for registered users.

If you consider that any rights may have been violated, the Participant shall file a complaint with the “Competent Supervisory Authority” regarding the protection of personal data.

12. Miscellaneous:

The acceptance of these Terms and Conditions constitutes permission for DORNA to use the names or nickname, country and results of Participants at its sole discretion for publicity purposes. DORNA may publish the data mentioned on esport.motogp.com and any other third -party authorized sites included but not limited to (youtube.com, facebook.com, twitter.com, newsletters etc.)

DORNA reserves the right to suspend, interrupt or cancel the MotoGP™ eSport Championship due to any unexpected cause without prior notice.

MotoGP™ eSport Championship is not open to employees of DORNA (and/or any employee of associated companies of DORNA), their relatives, agents or agents’ relatives or any employees of companies involved in the development or support of the esport.motogp.com.

DORNA cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any Participant entering the MotoGP™ eSport Championship.

DORNA is not responsible for any problems or technical malfunction of any broadband telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to a Participant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in relation to MotoGP™ eSport Championship.

By participating in the MotoGP™ eSport Championship, you agree that no claim relating to any such loss or injury (including without limitation special, indirect or consequential losses) shall be asserted against DORNA, its parent companies, sponsors, affiliates, directors, officers, employees or agents.
The present General Conditions, and any other additional conditions published on the esport.motogp.com constitute a full agreement between DORNA and the Participant in relation to the participation on the MotoGP eSport Championship.

If it is found by a Court that any of these General Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.

Nothing in these General Conditions and no action taken by the Participant or DORNA under this General Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other relationship between the parties beyond the contractual relationship established under these General Conditions.

The Participant is obliged to comply with any additional conditions indicated on the esport.motogp.com, likewise any conditions able to be modified in accordance with a change in law. DORNA will be permitted to modify in whole or in part the present General Conditions at any given moment, at its sole discretion and without prior notice to the Participant.

Force Majeure. For the purpose of these General Conditions, “Force Majeure” means any cause beyond the control of one of the parties including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, electricity black-out, network or server failure, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, actions taken by the police, acts or regulations of national or local governments. DORNA will not be liable to the Participant for failure to perform any obligation under these General Conditions to the extent that the failure is caused by Force Majeure

DORNA is entitled to assign any right and obligation under these General Conditions provided that the Participant’s rights are not adversely affected.
The present General Conditions are governed and subject to Spanish law, without reference to legal norms, and in the case of a dispute the Participant will be submitted to the jurisdiction of the Courts of Madrid, Spain.
The Participant acknowledges and agrees that he/she has read and understood these General Conditions and that he/she is fully aware of the rights and obligations arising there from.
